GENERAL TERMS and CONDITIONS OF SALE: Purchase of any product or service on The Birkin Fairy is subject to these Terms and Conditions (“Terms and Conditions of Sale”).
For each order on the Faairy.com website, your acceptance of the Terms and Conditions of sale in force at the date of the order will be requested.
TERMS of ORDERING: The Faairy.com website may be used to order a selection of products or services from The Birkin Fairy, directly online via the Internet. You may also place your order by telephone by dialing (650)-687-7655 7 days a week 8am-8pm CST. By placing an order over the phone, you confirm your unconditional acceptance of these conditions. The delivery zone for products ordered from Faairy.com may have restrictions.
PURCHASING PRODUCTS: For each product or service selected on the Faairy.com website, a summary will be displayed. You will be given the opportunity to review your selection before confirming your order. Upon confirmation, your order will be submitted to The Birkin Fairy for processing. While every effort is taken to try to ensure that the coloring, design and style of the products in the photographs displayed on the the Faairy.com website are representative of the original products, variations may occur due to technical restrictions of color reproduction on your computer equipment. The Birkin Fairy reserves the right not to accept or to cancel your order in our sole discretion for any reason without liability if, among other things, the products are not available, are incorrectly priced or are otherwise incorrectly described. Accordingly, The Birkin Fairy shall not be liable for any error or inaccuracy in the photographs or graphical representations of the products displayed on the Faairy.com website. The Birkin Fairy reserves the right to cancel any order placed by a customer with whom it has a dispute concerning a prior order, or if The Birkin Fairy has reasonable cause to suspect that such customer has violated these Terms and Conditions of Sale, or is engaged in any fraudulent activity or for any other legitimate cause.
AVAILABILITY of PRODUCTS: Our offers of products and services are valid as they are displayed on the Faairy.com website, subject to availability. Instructions about the availability of products and services are provided at the time of the ordering. At times, errors may exist, especially in case of simultaneous orders of the same product by several customers. In the case of unavailability of a product after ordering, you will be informed by email or by phone as soon as possible, and it will be proposed to you either to order another item shown on the Faairy.com website in substitution or to cancel your order.
The Birkin Fairy shall not be liable in case of stock outage or unavailability of products.
The Birkin Fairy reserves the right to change at any time and without notice the items or services proposed on the Faairy.com website.
ORDER CONFIRMATION: Once your order has been submitted to The Birkin Fairy for processing and may not be amended or cancelled except pursuant to the conditions provided for herein the Terms and Conditions of Sale or in conditions provided for pursuant to applicable law. The confirmation of your order means your acceptance of the Terms and Conditions of Sale.
PAYMENT: You are required to pay for any order placed on the Faairy.com website immediately upon confirmation of your order. We only accept payment by PayPal. Your order will only be dispatched once you have agreed to our Terms and Conditions of Sale and we have verified your payment method and funds are received into our account.
PAYMENT DISPUTE: In case of a payment dispute, you undertake to return the received products to The Birkin Fairy immediately upon request, and to assume the risks (in particular the loss, theft or damage) relating to the delivered products.
DELIVERY: Goods purchased via the Faairy.com website with a delivery address situated outside of the United States, may be refused during the ordering procedure. The Birkin Fairy will not process any order for which a post office box or APO/FPO address is provided. Packages are to be shipped to the purchaser and the purchasers billing address only. Our products are shipped by our chosen service method. A direct signature is required. By not providing a correct delivery address, your goods may be subject to a delay or cancellation by The Birkin Fairy. If tracking services are needed we will track the package for you. At no time will the tracking number be provided. The Birkin Fairy reserves the right to delay shipment until full payment is received into our account and may cancel your order at any time.
INTERNATIONAL DUTIES/TAXES: If your order is shipping outside of the US, you are likely to be charged customs fees (taxes, duties, processing fees, etc.) before delivery can be completed. Your purchase on faairy.com does not include custom fees. If you are not familiar with the customs fees in your country, please check with your local customs office for more information. We are unable to estimate customs fees, taxes, duties, etc. The delivery of your order could be delayed due to customs processing. If your order does not arrive in a reasonable amount of time, you should check with your local customs office to see if they are holding the package for payment of fees. Also, some customs offices will send a separate invoice for your customs fees that could arrive several weeks after you receive your shipment. The Birkin Fairy INC is NOT responsible for any International Duties, Taxes, Processing Fee’s ETC.
RETURNS: All Sales Are Final. No refunds, returns or exchanges.
AGREEMENT to ARBITRATE: You and The Birkin Fairy Inc. each agree that any and all disputes or claims that have arisen or may arise between you and The Birkin Fairy shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court, if your claims qualify. The Federal Arbitration Act governs the interpretation and enforcement of this Agreement to Arbitrate.
